Website Terms of Use

By using this site, you agree to the following:

  1. Enquiries only. Forms on this site are enquiries, not bookings. A booking is only confirmed once agreed directly with us, under our separate Booking Terms.
  2. Content. All text, images, and branding on this site belong to us and may not be copied or reused without permission.
  3. Accuracy. We keep this site up to date as best we can, but availability, prices, and details may occasionally change — please confirm specifics with us directly.
  4. Liability. We're not liable for losses arising from your use of this site, except where the law doesn't allow us to limit liability (e.g. death or injury caused by negligence).
  5. Analytics. This site uses Google Analytics — see our Privacy/Cookie Policy for details.
  6. Governing law. These terms are governed by the laws of England and Wales.

Privacy Policy

  1. What we collect. When you contact us to enquire or book, we collect your name, phone number, and email. Depending on your event, we may also collect the event address (if different from your home), a company name (for corporate bookings), event or significant dates, and the names of any family members the event is for (e.g. a birthday child).
  2. How we use it. Solely to respond to your enquiry and manage your booking. We don't send marketing emails.
  3. Who sees it. Only PayPal (for invoicing and payment), our bank/accountant (for bookkeeping), our legal advisors where relevant, and HMRC where required by law. We don't share your data with anyone else, and we don't use mailing list tools.
  4. Legal basis. We hold your data to fulfil our contract with you, to meet our legal obligations (e.g. tax reporting), and for our legitimate business interests. As we don't use your data for marketing, there's no opt-out to offer.
  5. How long we keep it. At least 7 years to meet UK tax record-keeping requirements, and up to 15 years for our own records. We review and clear out expired data annually.
  6. Photos/video. Separately, we may use photos or video from events on our website or social media — but only where this is offered and agreed with you in advance.
  7. Analytics. This site uses Google Analytics — see our Cookie Policy below for details.
  8. Security. Your data is stored on secure, backed-up systems (local and cloud), protected by antivirus and firewall software.
  9. Your rights. You can ask in writing (by emailing [email protected]) what data we hold about you, ask us to correct it, or ask us to delete it, subject to our record-keeping obligations. We aim to respond within 7 days and may need to verify your identity first. This is free unless you make multiple requests, in which case we may make a reasonable charge.
  10. Complaints. If you're unhappy with how we handle your data, you can complain to the Information Commissioner's Office (ico.org.uk).

Terms & Conditions of Booking

Marc Lemezma / Marli The Magician

All bookings made with Marc Lemezma / Marli The Magician are subject to these terms, which form part of your booking agreement and invoice, including where a booking is agreed verbally. Bookings can only be secured upon confirmation of a definite request by a client, agreement by Marc Lemezma, and payment of any required deposit. Marc Lemezma cannot hold dates without a confirmed booking and payment of the required deposit.

General

The details laid out in this invoice constitute an agreement for the provision of Entertainment Services & Supplies, as laid out in this document.

This invoice is a request for the full amount of the booking. Payment of the "minimum amount" shown is required within 24 hours of issue of this invoice to secure the date on your behalf. Payment of the "minimum amount" by the client shall be deemed as confirmation of the terms and conditions laid out herein.

Modifications

Modifications to the agreement and these conditions may only be made by mutual consent of the Client and Marc Lemezma.

Deposits / Confirmations

If a deposit (shown as the "Minimum Amount") is requested at the time of booking, this is payable by Credit Card, PayPal, or, upon special agreement, by electronic transfer. Until the required deposit is received and cleared, the booking is not fully confirmed. Deposits made against bookings are non-refundable.

The client may pay more than the "minimum amount" if they wish, or make additional payments leading up to the date of performance.

Fees & Payments

The balance of the fee for entertainment is payable by cash, cheque, bank transfer, or card, on the day of the booking on completion of the entertainment, unless other terms have been agreed in writing. Where party supplies have been ordered, the final balance will be adjusted on the day according to usage.

Insurance

Marc Lemezma holds £10 million Public Liability Insurance through Equity. Details are available on request.

Parking

If a car parking charge is payable, this must be paid by the client.

Outside Events

We recommend that the Client has an alternative plan in case of inclement weather. If the Artiste attends, the full fee will be payable.

Children

Whilst our artistes will always work in a safe and careful manner and be mindful of the health & safety of all, the Client is AT ALL TIMES responsible for the wellbeing, discipline, and care of all children present. Our artistes will not perform unless a minimum of two adults are present in the same room at all times.

Postponement

Should a problem arise that causes the client to postpone the entertainment with more than 7 days' notice of the performance date, it will be rescheduled for a mutually convenient time within 6 months of the booking date, at no extra cost and with no loss of deposit. Should the entertainment be postponed with less than 7 days' notice, then 30% of the full fee for entertainment becomes due. If the postponement is longer than 6 months, the booking will be regarded as cancelled.

The client must request an alternative date at the time of postponement; if they are unable to do so, the booking will be regarded as cancelled.

Any booking "postponed" on the date of performance shall be regarded as cancelled.

Cancellations

Should the client decide to cancel with less than 30 days' notice of the performance date, the full fee less estimated travel costs will become payable. Cancellations of over 30 days are accepted with no further fee other than any initial deposit paid. Cancellations can be made in writing, by email, or by telephone, but cannot be accepted on an answerphone.

Complaints

If you're unhappy with any aspect of your booking, please email [email protected] and we'll look into it.

Photography, Video and Sound recordings

Our artistes are, in most circumstances, more than happy for photography, video, or sound recordings to be made during performance. However, this must be with the Artiste's consent and must be limited to only those parts of the entertainment agreed with the artiste prior to starting. Any recording must be for private viewing/listening only.

Limitation of Liability

Notwithstanding any claims for personal injury, death, or damage covered by the artiste's public liability insurance, the artiste's liability in respect of this contract is limited to the value of the booking.

 

Law

These conditions, and any entertainment that takes place under them, shall be governed, construed, and take effect in accordance with the laws of England and Wales.

Special Terms for Children's Parties and Events

Parking must be available immediately adjacent to the venue.

Inflatables such as bouncy castles etc. must be switched off during performance if requested by the artiste.

Acceptance of these terms and conditions is implied when agreeing to book Marc Lemezma or Marli The Magician.

Child Protection & Accessibility Policy

This policy sets out how I work responsibly around children during my performances, and what parents, carers, and venues can expect from me on the day. At the heart of it is a simple point: I am an entertainer, booked to perform — not a carer, childminder, or anyone's supervising adult. Everything below follows from that.

  1. Responsibility stays with you. While I always take care to work safely and sensibly around children, responsibility for the wellbeing, behaviour, and supervision of all children present remains with the client/responsible adult(s) throughout the event. I am there to entertain, not to supervise or care for children. Where a venue has its own safeguarding policies — for example a school, nursery, or community hall — I will always work within those policies, so please make me aware of any specific requirements ahead of time.
  2. Two adults present. For everyone's safety and peace of mind, a minimum of two adults must be present throughout every performance.
  3. DBS. I hold a DBS check to the level legally applicable to the work I do. Clients should make clear any specific requirements they have when booking, and are welcome to arrange any further checks they may require.
  4. Vigilance. Although I'm not responsible for the children present, I remain alert throughout, and will raise any concerns I observe with the relevant authorities.
  5. Accessibility. My shows are welcoming to children of all abilities and backgrounds. If your child or event has specific access needs, please let me know in advance so I can plan accordingly.
